SUBJECT: Defense Federal Acquisition Regulation Supplement (DFARS); Small Business Competitiveness Demonstration Program

SOURCE: Federal Register, June 25, 2004, Vol. 69, No. 122, page 35566

AGENCIES: Department of Defense (DOD)

ACTION: Proposed Rule

SYNOPSIS: DOD is proposing to amend DFARS 219.1007, Procedures, to address the use of automated systems when making an award under the Small Business Competitiveness Demonstration Program.

DATES: Comments on the proposed rule must be submitted on or before August 24, 2004.

ADDRESSES: Submit comments, identified by "DFARS Case 2003-D063," to: (1) http://www.regulations.gov; (2) http://emissary.acq.osd.mil/dar/dfars.nsf/pubcomm; (3) e-mail: dfars@osd.mil; fax: 703-602-0350; (4) mail: Defense Acquisition Regulations Council, Attn: Donna Hairston-Benford, OUSD (AT&L) DPAP (DAR), IMD 3C132, 3062 Defense Pentagon, Washington, DC 20301-3062; (5) hand-delivery/courier: Defense Acquisition Regulations Council, Crystal Square 4, Suite 200A, 241 18th Street, Arlington, VA 22202-3402.

SUPPLEMENTARY INFORMATION: Paragraph (a)(2) of Federal Acquisition Regulation (FAR) 19.1007, Procedures, requires that "the face of each award made pursuant to the [Small Business Competitiveness Demonstration] program must contain a statement that the award is being issued pursuant to the Small Business Competitiveness Demonstration Program." To accommodate the use of automated systems, this proposed rule would add paragraph (a)(2) to DFARS 219.1007, which would state, "When it is not practical to mark the face page of an award document, alternative means may be used to identify the contract as an award under the Small Business Competitiveness Demonstration Program."
