ACTION: Proposed Rule

SYNOPSIS: It is proposed that FAR Subpart 15.6, Unsolicited Proposals, be amended to implement Section 834 of the Homeland Security Act of 2002 (Public Law 107-296), which adds new considerations concerning the submission, receipt, evaluation, and acceptance or rejection of unsolicited proposals.

DATES: Comments are due on or before August 4, 2003.

SUPPLEMENTAL INFORMATION: To implement Section 834 of Public Law 107-296, this proposed rule would:

• Amend FAR 15.603, General, to add a new paragraph (c)(6) that would require that a valid unsolicited proposal "not address a previously published agency requirement".
  
  
• Amend FAR 15.606-1, Receipt and Initial Review, to:
  
  
  • Revise paragraph (a)(4) to require that, before initiating a comprehensive evaluation, the agency determine the unsolicited proposal "contains sufficient technical information and cost-related or price-related information for evaluation" (current paragraph (a)(4) requires that the proposal "contains sufficient technical and cost information for evaluation"); and
    
    
  • Add paragraph (a)(5) that would require that the agency determine the unsolicited proposal "has overall scientific, technical, or socioeconomic merit" (current paragraphs (a)(5) and (a)(6) would be redesignated as paragraphs (a)(6) and (a)(7), respectively).
