ACTION: Final Rule
SYNOPSIS: This final rule revises NFS 1825.400, Scope of Subpart, and NFS 1852.213-70, Offeror Representations and Certifications - Other Than Commercial Items, to remove language pertaining to the Balance of Payments Program as a result of FAC 2001-07. This rule also makes miscellaneous administrative and technical changes to conform the NFS to the FAR, clarifies administrative procedures, and corrects references.

SUPPLEMENTAL INFORMATION: Item (2) of FAC 2001-07 removed FAR Subpart 25.3, Balance of Payments Programs. This final rule removes references to the Balance of Payments program from NFS 1825.400 and NFS 1852.213-70.
In addition, the following changes are also made to the NFS by this final rule:
- NFS 1804.670, Individual Procurement Action Report (NASA Form 507), is revised to delete the detailed explanations and instructions in NFS 1804.670-1, Applicability and Coverage, NFS 1804.670-2, Submission Due Date, and NFS 1804.670-3, Preparing Individual Procurement Action Reports (NASA Forms 507, 507A, 507B, 507G, and 507M), and substitute "The Headquarters Office of Procurement issues Procurement Information Circulars (PICs) to (a) identify the procurement actions subject to reporting; and (b) provide instructions on preparation of the NASA Forms 507."
- The following redundant language regarding offeror registration in the Central Contractor Registration (CCR) database and contract award is removed from paragraph (b) of NFS 1804.7403, Procedures: "If the offer results from an invitation for bids, determine the offer to be non-responsive and proceed to award to the next otherwise successful registered offeror." Also, NFS 1804.7402, Policy, and NFS 1804.7403 state that offerors must be registered in the CCR to be eligible for award "after March 31, 2001." The date is removed.
- The prescriptions in NFS 1813.302-570, NASA Solicitation Provisions, for NFS 1852.213-70, Offeror Representations and Certifications -- Other Than Commercial Items, and NFS 1852.213-71, Evaluation -- Other Than Commercial Items, are clarified, as are the prescriptions in NFS 1815.209-70, NASA Solicitation Provisions, for NFS 1852.214-71, Grouping for Aggregate Award, and NFS 1852.214-72, Full Quantities.
- The office symbol for the Headquarters Office of Procurement is changed from "HS" to "HC" in NFS 1804.601, Record Requirements, and NFS 1804.602, Federal Procurement Data System.
