SUBJECT: Army Federal Acquisition Regulation Supplement (AFARS) Revision #001; Miscellaneous Amendments

ACTION: Revision
SYNOPSIS: The Army is issuing AFARS Revision #001 to revise procedures for public announcement of contractual actions exceeding $5,000,000; option rejustifications; and determinations regarding advisory and assistance services.

EFFECTIVE DATE: November 29, 2001.
SUPPLEMENTAL INFORMATION: AFARS Revision #001 makes the following changes to the AFARS:
- Paragraphs (a)(i) of AFARS 5105.303, Announcement of Contract Awards, is deleted and replaced with a requirement that contracting officers report "all contractual actions, including modifications, that have a face value, excluding unexercised options, of more than $5 million. In addition, report all contractual actions which are of significance to local community, congressional, or Army interest" (the requirement to report contract actions over $5 million is added).
Also, paragraphs (a)(ii)(A)(i) through (iv) are deleted, and replacement paragraph (a)(ii)(A)(i) provides revised procedures and timetables for submitting the information specified in new AFARS 5153.9010, Congressional Notification (the primary change is the additon of procedures for when the contractual action "is of such an unusual and compelling urgency that the government would be seriously injured unless the award is made").
- To the end of the first subparagraph of paragraph (e) of AFARS 5106.303-1, Requirements, is added the following sentence: "In those cases where the option rejustification is to be approved by the Assistant Secretary of the Army (Acquisition, Logistics and Technology), the option rejustification need only be signed by the Principal Assistant Responsible for Contracting, prior to forwarding it electronically to the Office of the Assistant Secretary of the Army (Acquisition, Logistics and Technology) for approval. Option rejustifications, regardless of dollar value, shall not exceed 1 page."
- AFARS 5137.204, Guidelines for Determining Availability of Personnel, is added. It states, "The authority to make the determination is delegated to the Principal Assistant Responsible for Contracting."
