SUBJECT: Department of the Treasury Aquisition Regulation (DTAR) Change 98-10; Competition Requirements

ACTION: Department of the Treasury Acquisition Regulation (DTAR) Revision

SYNOPSIS: Procurement Instruction Memorandum (PIM) No. 00-1 modifies portions of DTAR Part 1006, Competition Requirements, to specifically prescribe the format for written determinations and findings (D&F) for establishing alternative sources, clarify when to use the Justification for Other than Full and Open Competition (JOFOC), and establish dates for the submissions of bureau and departmental annual competition reports.

EDITOR'S NOTE: The DTAR is Chapter 10 of Title 48 of the Code of Federal Regulations.

SUPPLEMENTAL INFORMATION: PIM No. 00-1 makes the following changes to DTAR Part 1006:

• DTAR 1006.202, Establishing or Maintaining Alternative Sources, is revised to add "in the format per [DTAR] 1001.704 [Content]" to "Submit D&F per [DTAR] 1001.7000(a) [Coordination and Approval]".
• DTAR 1006.303-2, Content, which addresses JOFOCs, is revised to clarify that a "Treasury-approved bureau form" may be used to document justifications and approvals (previously, it had said a "bureau-approved form" could be used), and to revise the threshold for submitting the JOFOC from $500,000 to the $100,000 simplified acquisition threshold.
• DTAR 1006.502, Duties and Responsibilities, which addresses competition advocates, is revised to remove the reference to TD P 76-01.F, The Competition in Contracting Act Handbook (August 1992), and replaces it a requirement that bureau competition advocates submit annual reports to the departmental advocate for competition by November 30 (covering the prior fiscal year), and that the departmental advocate for competition submit an annual departmental report to the procurement executive by January 31.
